Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the PowerScale mobile application (“App”) and related services (“Services”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who we are
PowerScale is provided by the developer identified in the App Store listing (“we,” “us,” or “our”).
2. Eligibility
You must be old enough to enter a binding contract where you live and meet any minimum age required by Apple’s App Store in your region (typically at least 13 in the United States). If you are under the age of majority, you may use the App only with a parent or guardian’s consent.
3. Accounts and security
Some features require an account. You are responsible for your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
4. Changes to the Terms
We may update these Terms from time to time. The “Last updated” date will change when we do. If you continue to use the App after changes become effective, you accept the revised Terms.
5. License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, subject to these Terms and Apple’s applicable App Store rules.
6. Subscriptions and in-app purchases
If you purchase a subscription or other in-app product, payment is processed by Apple. Subscription terms (including price, renewal, and cancellation) are presented at purchase and in your Apple ID subscription settings. To the maximum extent permitted by law, refunds are handled by Apple according to Apple’s policies.
7. Third-party services and content
The App relies on third-party services and data sources (for example, catalog/metadata providers such as AniList, authentication and cloud services such as Google and Firebase, and advertising services). Those third parties may have their own terms and privacy practices. Anime and manga titles, artwork, descriptions, and related metadata are owned by their respective rights holders; PowerScale does not claim ownership of that third-party content.
8. User conduct
You agree not to: (a) use the App unlawfully or to harass, abuse, or harm others; (b) attempt to interfere with or disrupt the App or its infrastructure; (c) scrape, reverse engineer, or circumvent security; (d) upload malware; or (e) use the App to infringe intellectual property or privacy rights.
9. User content
If you post or share content (such as profile information, discussions, or media), you represent you have the rights to do so. You grant us a worldwide license to host, store, reproduce, and display that content solely to operate and improve the Services, subject to our Privacy Policy.
10. Intellectual property
The App’s branding, UI, and original software are protected by intellectual property laws. Except for the limited license above, no rights are granted.
11. Disclaimer
THE APP AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
13. Indemnity
You will defend and indemnify us against claims arising from your misuse of the App, your content, or your violation of these Terms, to the extent permitted by law.
14. Termination
We may suspend or terminate access to the App if you violate these Terms or if we discontinue the Services. You may stop using the App at any time.
15. Apple App Store
If you obtained the App from Apple’s App Store, you acknowledge that these Terms are between you and us, not Apple, and Apple has no obligation to furnish any maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App or your possession or use of the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) to the maximum extent permitted by Apple’s policies; Apple will have no other warranty obligation. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the App.
16. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where prohibited by the mandatory consumer-protection laws of your country of residence.
